LEGAL NOTICE

 Notice is hereby given that on Wednesday, July 16, 2025, at 5:30 PM, the Sharon City Council will hold a Public Hearing as part of its regular meeting of Council to hear, review and consider an Ordinance amending the Zoning Ordinance for the City.  The proposed zoning ordinance amendment will provide the following changes to the zoning ordinance: 

  • Section 1 creates new definitions similar to the commonly understood meaning for “Gaming Facility” and “Smoke Shop.” 
  • Section 2 permits the Gaming Facility use in the C-2, M-1, M-2, and M-3 zoning districts, subject to the requirements in the new Section 309.37 of the Zoning Ordinance.  It also permits the Smoke Shop use in the same C-2, M-1, M-2, and M-3 zoning districts, subject to the requirements in the new Section 309.38 of the Zoning Ordinance. 
  • Section 3 provides the criteria for the Gaming Facility use, which requires that the use obtain all permits, licenses, and other requirements under the law; that all uses be considered legal under prevailing law; that all such buildings not utilize opaque windows that prevents people outside from seeing in the building; that the use not be located within 1,000 feet of an educational institution, child care facility, youth center, community center, recreational facility, park, church or religious institution, hospital, or other use where individuals under 21 years of age regularly gather; and that it not be located within 1,000 feet of another Gaming Facility. 
  • Section 4 provides the criteria for the Smoke Shop use, which requires that the use obtain all permits, licenses, and other requirements under the law; that all uses be considered legal under prevailing law; that all such buildings not utilize opaque windows that prevents people outside from seeing in the building; that the use not be located within 1,000 feet of an educational institution, child care facility, youth center, community center, recreational facility, park, church or religious institution, hospital, or other use where individuals under 21 years of age regularly gather; and that it not be located within 1,000 feet of another Smoke Shop. 
  • Section 5 provides that the provisions of the Ordinance are severable, while Section 6 repeals all other conflicting ordinances, and Section 7 renders the Ordinance effective ten (10) days from its adoption.
